General Terms and Conditions of Sale

These terms and conditions of sale are concluded on the one hand by Miprixauto, owned by DGJAUTO S.L.U, whose registered office is located at Cami les Forques 41, 17600 Figueres, province of Girona, Spain, registered under NIF number B55226609 with a share capital of €3,000, hereinafter referred to as Dgjauto S.L.U, and on the other hand, by any natural or legal person wishing to make a purchase via the website of Miprixauto, owned by DGJAUTO S.L.U, hereinafter referred to as “the buyer”.

Purpose

The purpose of these terms of sale is to define the contractual relationship between Miprixauto, owned by DGJAUTO S.L.U, and the buyer, as well as the conditions applicable to any purchase made through the online store of Miprixauto, owned by DGJAUTO S.L.U, whether the buyer is a professional or a consumer. Purchasing a good or service through this site implies the buyer’s unconditional acceptance of these terms of sale.

These terms of sale shall prevail over any other general or special conditions not expressly approved by Dgjauto S.L.U. Dgjauto S.L.U reserves the right to modify its terms of sale at any time. In this case, the applicable conditions will be those in force at the date of the buyer’s order.

Characteristics of goods and services offered

The products and services offered are those listed in the catalog published on the website of Miprixauto, owned by DGJAUTO S.L.U. These products and services are offered within the limits of available stock. Each product is accompanied by a description provided by the supplier. Packaging may be opened for photo purposes and for quality control before shipment. A mark is applied for identification in case of return.

The catalog photographs are both contractual and non-contractual; they cannot ensure a perfect resemblance with the product offered, particularly regarding colors.

Prices

The prices listed in the catalog are in euros, including VAT at the rate applicable on the day of the order. Any change in the rate may be reflected in the price of the products or services. Miprixauto, owned by DGJAUTO S.L.U, reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog at the time of the order will be the only one applicable to the buyer. The indicated prices do not include order processing, transportation, and delivery fees, provided these take place in the geographical areas defined below.

Geographical area

The online sale of the products and services presented on the website is reserved for buyers residing in France, the French overseas departments and territories, Monaco, the European Union, Canada, and the United States, and for deliveries required within these geographical areas.

Orders

The buyer wishing to purchase a product or service must:

- complete the identification form by providing all required contact details or give their customer number if they have one;

- complete the online order form by providing all the references of the chosen products or services;

- verify and validate their order;

- make payment under the conditions provided;

- confirm their order and payment. Confirmation of the order implies acceptance of these terms of sale, acknowledgment of full knowledge thereof, and waiver of the buyer’s own purchase conditions or other conditions. All data provided and the recorded confirmation will serve as proof of the transaction. Confirmation will constitute a signature and acceptance of the operations carried out. The seller will send confirmation of the registered order by email.

Withdrawal and Returns

Buyers, being private individuals (non-professionals), have a withdrawal period of fourteen days from delivery of their order to return the product to the seller for exchange or refund. Return shipping costs shall be borne by the buyer. Any incomplete, damaged, or installed item, or one without its original packaging, will be refused. Poorly packaged parcels or those likely to be damaged will be refused.
Purchases handed over in person and returned within seven days will receive a credit valid for two months.
Returns must be made only via tracked parcels (e.g., Colissimo). No relay points or other delivery companies will be accepted. Electronic and electrical items such as control units, injection pumps, keys, etc., cannot be returned due to their single-use nature.
In case of a warranty claim, you must provide the professional installation invoice (see Warranty section).
Intentional errors (testing based on resemblance/adaptation despite clear indications in the listing) will not be subject to return or claim.

Payment Terms

Payment is due at the time of order.

Payments shall be made by bank transfer or credit card; they will be carried out through a secure system using the SSL (Secure Socket Layer) protocol so that the transmitted information is encrypted by software and no third party can access it during transmission over the network.

The buyer’s account will be debited at the time of order for the amount of the products or services sent or downloaded. Upon the buyer’s request, an invoice will be sent, available for printing from their customer account.

Bank transfers generating additional fees must be covered by the buyer, especially for transfers from Switzerland (€18).

Deliveries

Deliveries are made to the address indicated on the order form, which must be within the agreed geographical area. The risks are borne by the buyer from the moment the products leave the premises of Dgjauto S.L.U.

We offer four shipping methods: GLS (delivery after drop-off estimated between 24H and 48H), La Poste (delivery after drop-off estimated at 48H), Envialia and Correos (delivery after drop-off estimated at 72H).

Shipping fees include transport, packaging, and order processing costs.

The customer must check the condition of the packaging and the products upon delivery. The customer must not sign the delivery note without making specific reservations (e.g., anomaly, damaged product...)

In case of damage during transport, a motivated claim must be made to the carrier within three days of delivery. Delivery times are given for reference only; if they exceed thirty days from the order, the sales contract may be canceled and the buyer refunded.

In case of non-collection of the parcel, please contact us to request a refund or reshipment (at the buyer’s expense). If no response is received from the buyer after 30 days, a credit will automatically be issued to their customer account, valid for one year excluding shipping costs.

Warranty

All products supplied by the seller are covered by the legal warranty provided for in Articles 1641 and following of the Civil Code. In the event of non-conformity of a sold product, it may be returned to the seller, who will take it back, exchange it, or refund it. The warranty applies only if the item was installed by a professional (please attach the professional installation invoice). Intellectual property: All elements of the Miprixauto website, owned by DGJAUTO S.L.U, are and remain the intellectual and exclusive property of Dgjauto S.L.U.

No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, any elements of the site, whether software, visual, or audio. Any simple or hypertext link is strictly prohibited without the express written consent of Dgjauto S.L.U.

Personal Data

In accordance with the law relating to data processing, files, and freedoms of January 6, 1978, personal information relating to buyers may be subject to automated processing. Dgjauto reserves the right to collect information on buyers, including by using cookies, and, if desired, to transmit the collected information to commercial partners.

Buyers may object to the disclosure of their personal data by notifying Miprixauto, owned by DGJAUTO S.L.U. Likewise, users have the right to access and rectify information concerning them, in accordance with the law of January 6, 1978. The automated processing of information, including the management of users’ email addresses, was declared to the CNIL on 22/12/2013 under number 1730527.

Archiving / Proof

Miprixauto, owned by DGJAUTO S.L.U, will archive order forms and invoices on a reliable and durable medium constituting a true copy in accordance with Article 1348 of the Civil Code. The computerized records of Miprixauto, owned by DGJAUTO S.L.U, will be considered by the parties as proof of communications, orders, payments, and transactions between the parties.

Dispute Resolution

These online sales terms are subject to Spanish law. In the event of a dispute, jurisdiction is assigned to the competent courts of Girona, notwithstanding multiple defendants or third-party claims. T972 501 680
